The High Court has postponed the government order to create a merit list at the number five from the number of the candidates who took part in the admission test for the MBBS course in the medical college. At the same time, the rule has been issued to know why it is not illegal to create a merit list by remitting five numbers from the number of candidates who have taken second place.

According to the writ petition, a circular published on August 21 in the Department of Health. In the 6th column of the notification, it is said that merit list will be prepared by cutting the number 5 from the total number of HSC passed candidates in the previous year in the MBBS / BDS admission test for the year 2017-2018. Others will not be cut off. This decision is discriminatory. This decision is contrary to Article 7, 26, 27, 28 and 31 of the Constitution.

According to the writ petition, the National Education Policy, 2010's Medical and Health Strategy Chapter number 1 mentioned that admission test for admission in medical college will continue till admission test. In the admission test, a candidate can get a chance to participate for two years. So, the government has decided to cut the number 5 pass takers from the previous year, it is contrary to the education policy.
